1. Who you are contracting with

Service Market Hub (the "Service") is operated by Garrick International Solutions("we", "us", "our"). By accessing or using the Service you ("you", the "user") enter into an agreement with Garrick International Solutions on the terms set out below.

2. Acceptance of terms

By creating an account or continuing to use the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.

3. The service

The Service provides booking, scheduling, client, and invoicing tools for service businesses. We may add, modify, or remove features from time to time.

4. Acceptable use

You must not misuse the Service. You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Send spam or unsolicited communications.
• Infringe the intellectual property or privacy rights of others.
• Upload or distribute malware, or attempt to probe, scan, or test the vulnerability of the Service.
• Scrape, harvest, or otherwise extract data from the Service in bulk.
• Reverse engineer, decompile, or attempt to derive the source code of the Service.
• Resell or redistribute the Service except as expressly permitted.

5. Accounts and credentials

You must provide accurate information when creating an account, keep your credentials confidential, and are responsible for activity that occurs under your account.

6. Intellectual property

We retain all right, title, and interest in and to the Service, including all software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of content you upload and grant us a limited licence to host and process that content solely to provide the Service.

7. Payment, subscriptions, and refunds

Paid plans are billed on a recurring basis (monthly or annual, as selected at checkout) until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, and refunds are governed by the Paddle Buyer Terms. See our Refund Policy for refund details.

8. Service levels and disclaimers

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Suspension and termination

We may suspend or terminate your access to the Service if:

• You materially breach these Terms;
• Payment for your subscription fails or is not made when due;
• We reasonably believe your use poses a security or fraud risk; or
• You repeatedly or seriously violate our policies or applicable law.

You may stop using the Service at any time by cancelling your subscription. Upon termination, your right to use the Service ends, and we may delete your data after a reasonable export window.

11. Changes to the terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Garrick International Solutions is established, without regard to conflict of laws principles.
